  • Position Summary

    Discovery Communication’s Business and Legal Affairs Department seeks an enthusiastic, proactive and motivated team player to work within all commercial and legal aspects of Discovery Networks Asia’s content commission, co-production, acquisition and talent deals for Discovery's products across the Asia and India regions.  The successful candidate will be self-motivated with strong business affairs and legal negotiating experience and a detailed knowledge of the content production distribution and acquisition business across a variety of mediums, including both pay and free TV, video on demand and online.  Contacts amongst factual and lifestyle programme producers and distributors required.

    Responsibilities

    • To negotiate all commercial and legal terms relating to the acquisition commissioning and co-production of content for Discovery’s channels across the Asia and India regions within internal budget guidelines.
    • Establish maintain and develop relationships with key content suppliers
    • Assist in sourcing of content in accordance with the editorial requirements of the channels working closely with channel editorial teams.
    • Provide market intelligence research and support for business initiatives as directed
    • Format, draft, and negotiate programming agreements such as development, acquisition, commission, co-production, format, talent and licensing agreements and associated agreements such as distribution agreements, independent contractor agreements, location and participant release agreements.
    • Liaise with network and third party production companies to negotiate and complete such agreements.
    • Trouble shoot various programming business and legal issues, including drafting responses to claim letters, drafting delay notification letters, termination agreements, assisting with pre-publication review and legal compliance content review, and liaising internally and externally as appropriate regarding high exposure rights clearances.
    • Revise and update Hive database and such other information tracking mechanisms in use within the company.
    • Supporting other company business initiatives as directed, for example, Corporate Legal and Corporate Development, on a variety of issues including regulatory, litigation and mergers/ acquisitions.
    • In consultation with the SVP/VP Business and Legal Affairs and local senior business leaders, contribute to strategy and policy discussions.
    • Manage a small business and legal affairs team based in region.

    Requirements

    • Minimum of 4 years negotiating experience working in acquisition/business affairs team in the entertainment industry buying and/or selling commissioning and acquiring TV rights, preferably in an in house legal team. Qualified lawyer required.  
    • Extensive contacts with programme producers, distributors and broadcasters.
    • Excellent negotiation, drafting and contract analysis skills and proven experience in resolution of complex rights issues
    • Excellent interpersonal skills, including clear and effective communication at junior and senior level within and outside the company
    • Good organizational skills and ability to work well under pressure.
    • Ability to handle high volume of work, as well as recognize priorities and manage time effectively to meet deadlines.
    • Ability to function on an independent basis, with moderate supervision.
    • Knowledge of television business, free to air, cable, pay and satellite TV industry and general entertainment industry and ‘new media’ developments. Working knowledge of union and guild issues helpful.
    • Understanding of Asia/ Indian production practices would be beneficial.
    • Knowledge of Mandarin or another language of the region would be helpful.
    • Computer skills extremely valuable (including Microsoft Word, Excel, Outlook, Powerpoint. Knowledge / experience setting up databases, tables, knowledge of redlining software).
